Terms and Conditions
Before you commisision
By commission me, you are agree with my terms of services.
All prices shown are non-commercial use.
Please read my terms of service before commissioning.
1. Service Definition
1.1. The "Artist" refers to the digital illustrator and animator introduced as Jynn, while the "Client" refers to the individual or entity commissioning the digital illustration.1.2. The service includes the creation of a custom digital illustration as per the mutually agreed specifications between the Artist and the Client.
2. Pricing and Payments
2.1. The total price for the digital illustration will be agreed upon between the Artist and the Client before commencing the project.2.2. The payment of the totality of the price is required before the Artist initiates the project.2.3. The Artist will provide a low-resolution version of the illustration for review.2.4. Payments can be made through Chilean bank transfer or PayPal and within the agreed payment timeframe.
3. Delivery Deadlines
3.1. The Artist and Client will agree on an approximate delivery time for the project.3.2. Both parties agree that the delivery deadline may be extended in the case of unforeseen circumstances or justified delays. Both parties will be notified of any deadline extension.3.3 The delivery time frame will depend on how complex the digital illustation is, as well as how many commissions the Artist have open at the same time.
4. Review and Changes
4.1. The Client is entitled to 3 rounds of revisions during the creation process. Any additional revisions may incur additional costs.4.2. Change request has to be made in the sketch process or the base coloring process. Any change request out of these processes may incur additional costs.4.3 Change requests must be submitted in writing and clearly. The Artist will endeavor to make changes as requested, provided they are within the agreed-upon scope of the project.4.4 The artist just will provide previews of the sketch, the base colored illustration and the illustration finished.
5. Copyright and Intellectual Property
5.1. The Artist retains all copyright rights to the digital illustration unless otherwise agreed upon in the agreement.5.2. The Artist may use the illustration in their portfolio and for promotional purposes unless otherwise agreed upon with the Client.5.3 The Artist reserve the right to post any of the artwork made by them on social media unless otherwise agreed upon with the Client.
6. Cancellations and Refunds
6.1. In the event of project cancellation by the Client before the delivery of the final illustration, payments will not be refundable, and any work completed up to that point will be the property of the Artist.6.2. The Artist reserves the right to cancel the project if unforeseen circumstances arise or if there are breaches made by the Client. In such a case, any received payments will be refunded less costs incurred up to the date of cancellation.
7. Confidentiality
7.1. Both parties agree to maintain the confidentiality of project details while it is carried out unless otherwise agreed upon.
8. Applicable Law and Jurisdiction
8.1. This contract shall be governed by the laws of Chilean jurisdiction, and any disputes shall be resolved by the communication of both parties or in the courts of Santiago, Chile.
9. Acceptance of Terms and Conditions
9.1. The Client accepts these terms and conditions when placing an order and making the payment.
